I really appreciate what you are trying to do in making the artwork of the Minnesota State Capitol widely available. However, there may well be some copyright problems with these uploads. Works created for the United States Government, such as official portraits of federal officials, are generally in the public domain. The same is not generally true for state portraits. The copyright holders on these portraits are most likely the individual artists, or perhaps the state of Minnesota. The photographs are derivative works of those portraits. So, we need to research who holds the copyright on those portraits.

I am working with and "as" the Minnesota Historical Society on this. Specifically, I am in dialog with Diane L. Adams-Graf, Curator of Sound and Visual Collections and Brian Szott, Curator of Art for the Minnesota Historical Society. The Society, through the State of Minnesota, holds and manages the rights on the Governor's portraits. The Minnesota Historical Society would like to work more with Wikipedia on this because hopefully this is just the start of what we can offer. Sadly the rights on Governor's portraits cannot be released into the public domain (at least not very easily without some legislative action) even though there may be interest in that possibility. The Society however, does have the ability to release it on a educational license and hopefully to Wikipedia through their "Non-free use media rationale" since there are no free equivalent photos of these governors with the exception of Jesse Ventura (the only free photo of him is not of him during his governorship and thus should not be included in the Governor info box) and Wendell Anderson (the calm that it is Federal portrait is dubious since the photo is of him in the MN Governors office).
These are baby steps by the Society and the public significance of the Governors portraits made them easy candidates to convince others that they should go on Wikipedia. I have been working to add pre 1923 artwork of the governors and also of historically significant photos to Wikimedia Commons and to Wikipedia. We are looking at how we can use our images from our collection to fill gaps in knowledge and enhance Minnesota history on Wikipedia.
I have helped to create and am managing the Society's own public wiki Placeography.org and have an appreciation for what a nightmare it is to deal with rights on a wiki and Wikipedia's is far more advanced than Placegraphy's. Any help/advice/advocacy by talented and knowledgable Wikipedian's would be welcome on the MN Governor's portrait issue.

I left a question at Wikipedia:Media copyright questions#Minnesota Historical Society images to see if people could figure out the copyright situation. It seems like it should be straightforward: if the Minnesota Historical Society is willing to upload images to which they have copyright, and they're willing to do so under the standard non-free content criterion, then Wikipedia should be able to accept them. I asked ST47 ( talk · contribs) about the warning messages and the templating. He said that it was a bug in his code, where he didn't expect the copyright tag to take up more than one line, so he fixed it. So, in other words, it appears that there are no copyright problems, just an image tagging bot that didn't realize that you were doing something OK. Replaceable fair use File:HaroldStassenOfficialOil.jpg

I noticed the description page specifies that the media is being used under a claim of fair use, but its use in Wikipedia articles fails our first non-free content criterion in that it illustrates a subject for which a freely licensed media could reasonably be found or created that provides substantially the same information. If you believe this media is not replaceable, please:

  1. Go to the media description page and edit it to add {{ di-replaceable fair use disputed}}, without deleting the original replaceable fair use template.
  2. On the image discussion page, write the reason why this image is not replaceable at all.

Alternatively, you can also choose to replace this non-free media by finding freely licensed media of the same subject, requesting that the copyright holder release this (or similar) media under a free license, or by taking a picture of it yourself.

The Minnesota Historical Society, through the State of Minnesota, holds and manages the rights on the Governor's portraits.
