This is not customary usage among lawyers in the United States by my reckoning. The phrase is always "small claims court" in the Indiana Rules for Small Claims, in any case. Smerdis of Tlön 15:15, 18 November 2005 (UTC) reply

Small claims courts in England & Wales

I've edited references to England & Wales as the jurisdiction does not have a small claims court. It is a commonly held misconception as it has small claims actions, though these are held in the normal county courts. To imply that a county court IS the UK name for a small claims court is deeply misleading as they can hear cases far in excess of small claims actions.

Mentioning multi-track claims in the section only muddied the waters further - there is no way a multi-track case could be said to be heard in a small claim yet, under the original writing, it was seen to be held in a 'small claims court' 90.194.207.222 ( talk) 22:18, 2 July 2010 (UTC) reply

I agree. I've modified slightly because the £5,000 limit doesn't apply to all forms of claim (eg personal injury) and falling below the value limit won't guarantee you get allocated to the small claims track (eg in defamation cases). Its an important point because the court (rather than the applicant) controls what track is used and that can have serious costs consequences. Francis Davey ( talk) 16:47, 6 July 2010 (UTC) reply

Can someone explain why they reverted this change? Since the reversion is wrong and they've failed to give any reason for the reversion on the talk page I'm going to revert it again. I've changed the lead to make it clear that there is no small claims court in England. The definition in the lead (which seems reasonable) implies a court of limited jurisdiction. In theory its possible for a county court to hear a very wide range of disputes on the small claims track if all parties consent (its rare but they do).
