although Appleton's Cyclopedia says this Patton was a judge of the Virginia Court of Appeals, he doesn't appear on the list of justices, so he may have been a local circuit court judge in Richmond, although the 1850 census merely lists him as a lawyer. Unfortunately, ancestry.com has changed its indexing of the 1850 federal census slave schedules and the library is closing, so I cannot document his slaveholdings.
