It sounds like a substantial portion of what makes Boxee Boxee is not Free/Open Source. Given that, I think it's misleading to call this FOSS at all. "Based on FOSS" would be fair.
Also, the sentence "Since these source code libraries are released under free and open source licenses they are legally redistributable." is not logically accurate; FOSS works on the basis of copyright law alone (except GPLv3 and similar, but that's irrelevant here), and trademark and patent law could make a piece of FOSS not legally redistributable. That's why no major Linux distros ship patent-encumbered media codecs without a patent license agreement. GabrielBurt ( talk) 01:43, 5 December 2008 (UTC)
Yeah, Boxee as a whole is NOT Open Source. One of the main libraries that differentiates Boxee from XBMC (the Open Source project upon which Boxee is based) is libBoxee.a, which is not open sourced. [1]. There are also questions about the license agreements required being in violation of the GPL [2] [3] (Full disclosure: the 2nd link is a story covering my blog on the subject).

As of 2009 May 1, the Boxee source distribution '0.9.11.5777' contains -lBoxee as source code, which builds (after a minor change or two) on AMD64. One presumes this source code is under the GPL. 218.185.10.132 ( talk) 05:00, 1 May 2009 (UTC)

How much iron is it gonna take to run this? Does the P2P aspect mean viewers must give in order to get? Will netbook owners be able to use this or is strictly for the quad core crowd?

According the website it says that "Users want to see more content on Boxee. Content owners want to be paid for what they produce (whether that’s TV Shows, movies, music, or applications). Boxee will this fall release a new device called "Boxee TV" cooperation with D-Link, and they still stop releasing updates for their old Boxee Box (which was also made by D-Link), see the post on Boxee's blog; "we are also working to release a separate update to the Boxee Box to update the Flash player and fix some key bugs. After this update the Boxee Box will go into maintenance mode. We will discontinue its distribution and will not be releasing any additional major updates." [4]. In fact not much in this new device will be the same as a the old, as both the hardware and the software have been completely replaced with something else, even though the user interface will look similar. It will be ARM CPU based and use all new proprietary software, so none od the old addons/apps/plugins will work with the new box without being rewritten. And while the old box was aimed at people downloading stuff themselves so it supportaed all kinds of formats, the new box will only support the most common and popular formats, and be aimed at people watching mostly broadcast TV, and some online streams.
