This image is a portrait studio photograph taken at "Studio Otto" ca. 1900. Karla Jay's book The Amazon and the Page (1988, ISBN  0-253-20476-3), which uses it as a cover image, credits Renée O'Brien (Vivien's niece) and the Bibliothèque Doucet for permission. Vivien died in 1909, so if she held the copyright, the photo would now be public domain; if it was published during her lifetime, it would be public domain in the United States. However, since I haven't been able to establish either circumstance:

I ( —Cel ithemis) believe that the use of this photo in the article Natalie Clifford Barney is fair use under United States law, because:

  • it is used to illustrate the people depicted and their relationship
  • no free alternative can be created
  • it is low-resolution
  • it does not interfere with the copyright holder's ability to sell art prints of the image (any print made would be extremely low-quality)
